Terms and Conditions

1 Scope

The following terms and conditions apply to all orders placed by customers through our online shop diagmarket.eu.

2 Conclusion of the contract

The offers are aimed exclusively at customers with a delivery address in selected countries of EU. The customer must be at least 18 years old.

The presentation of the products in the online shop does not constitute a legally binding offer, but a non-binding online catalogue. You make a binding offer for the goods in your shopping cart when you go through the online ordering process and click on the "Order with obligation to pay" button in the last step of the ordering process. The confirmation of receipt of your order is sent by automated e-mail immediately after the order has been sent and does not constitute a declaration of acceptance. The purchase contract is only concluded by a declaration of acceptance by us. This occurs with the payment method prepayment upon receipt of our request for payment, with all other payment methods upon receipt of a shipping confirmation by e-mail.

The validity of contracts for larger quantities than those normally found in a household, as well as the commercial resale of the purchased item, requires our express confirmation. This is particularly necessary to ensure the minimum stock of individual products or product groups. Furthermore, we shall be released from our obligation to perform and may withdraw from the contract if we ourselves are not supplied, although we have placed congruent orders with reliable suppliers.

We store the information relating to your order after the contract has been concluded.

The contract is concluded with Diag Store s.r.o., entered in the Commercial Register: Municipal Court in Prague, register number: C 363733, with registered office at Hornomecholupska 1196/58, 102 00, Prague, Czech Republic, CIN: 14335603, VAT no.: CZ14335603.

3 Prices and shipping costs

All prices include the applicable statutory value added tax and are exclusive of shipping costs and any additional shipping costs that may be specified for bulky items. The additional shipping costs may vary depending on the type of delivery and the nature of the item (e.g. freight forwarding items). The prices at the time of the order apply. 4 Payment

In the event of payment by online payment method (e.g. PayPal, credit card, Google Pay, Apple Pay) you expressly authorise us to collect the amounts due at the time of the order. When paying with PayPal, you will be redirected to the PayPal website during the order process to make the payment via your PayPal account.

If you pay in advance, you must transfer the full invoice amount to our account within four calendar days of receipt of the order, stating the purpose of the payment. We reserve the purchased item for a period of four calendar days.

The goods delivered to you remain our property until the purchase price has been paid in full.

5 Warranty and guarantees

If guarantees are advertised, the details can be found in the guarantee conditions. In the event of defects in the purchased item or the digital product, you are entitled to the statutory warranty rights. Your statutory warranty claims are not limited by a guarantee. Standard warranty for private customers is 2 years from delivery of goods. The warranty for enterpreneurs is valid for one year from delivery. More info on Return Policy and Warranty page.

6 Right of cancellation

Consumers are entitled to cancel the purchase contract within 14 days of receipt of the goods. Entrepreneurs are not granted a general right of cancellation. More info on Return Policy and Warranty page.

Consumers do not have the right to withdraw from the contract in particular in the case of contracts:

  • for the supply of goods which have been adapted to the consumer's wishes or for his/her own person,
  • the supply of an audio or visual recording or a computer program if the original packaging has been damaged,
  • in the case of contracts for the supply of digital content, if it has not been supplied on a tangible medium.

7 Applicable law

If you are a business, the law of Czech Republic shall apply exclusively, to the exclusion of the UN Convention on Contracts for the International Sale of Goods. The law of Czech Republic shall apply to consumers insofar as this does not deprive them of the protection afforded to them by mandatory provisions of the country in which they have their habitual residence.

8 Information on online dispute resolution and participation in a conciliation procedure

The European Commission provides a platform for online dispute resolution, which can be accessed by the user at https://www.ec.europa.eu/consumers/odr. We are not obliged or willing to participate in dispute resolution proceedings before a consumer arbitration board.

Nevertheless, we endeavour to resolve any differences of opinion arising from a contract amicably.
